dccm causing tempfails

i pasted what i get when running 'sendmail -Ac -q -v', this is
the sendmail log on the server for that particular mail:

usually i'd get a 'Milter change: header ...' entry for this message, but
not in this case. (I have whitelisted 127.0.0.1 with mxdcc to retain the 
X-DCC header).

yes, i'm getting these:

Sep  1 17:00:21 rago dccm[17715]: 1 too many simultaneous mail messages
Sep  1 17:00:24 rago dccm[17715]: 3 too many simultaneous mail messages

and these occur too from time to time:

you can neglect the Received header on these mails, it's sent from an 
independent system running 8.12.11. the boxes with dccm are running 
8.13.4.
