Yehudi Sabbagh sent this demand that his name be removed from the Rhyolite Software list of related unwelcome domains.
Mr. Sabbagh's name is present because it is the administrative contact for several domain names associated with objectionable mail sent to addresses at rhyolite.com. For example, consider the the internetole.com and publimails.com whois entries as of October, 2004. Mr. Sabbagh seems to agree in his message that data is correct. The names of people and organizations associated with domain names in the Rhyolite Software list of unwelcome domain names are not necessarily owners of those domain names. It is impractical for outsiders to know who actually owns a domain name. Instead the names of people and organizations are used to recognize organizations and people whose mail is unwelcome at Rhyolite Software.
Several domain names associated with Mr. Sabbagh's name are in the Rhyolite Software list because of unsolicited bulk mail sent to mailboxes in the rhyolite.com domain. Most of this objectionable mail has been sent to addresses that have never been valid. It seems that Mr. Sabbagh or his employers, customers, or other associates have "harvested" targets for advertising mail. Perhaps Mr. Sabbagh or his lawyer should check what the CAN-SPAM Act says about "harvesting."
Consider this representative sample of unsolicited bulk mail or spam from a dccm logdir file. The "spam trap address" which received that message has been censored to prevent "listwashing." See also the public record of related unsolicited bulk mail.
Please note that the CAN-SPAM-Act does not require that targets of unsolicited bulk mail accept spam nor even to "unsubscribe" from it. We are free to deploy mechanisms to prevent its reception, including refusing all mail from domain names associated with organizations that have previously sent spam.
If Mr. Sabbagh's Boulder Colorado attorney exists, he should have informed Mr. Sabbagh of several other things. One is that the truth of Mr. Sabbagh's association with the domain names in the Rhyolite Software list of unwelcome domain names makes claims of defamation surprising. Another is that legal threats should pass from Mr. Sabbagh's attorney to mine instead of directly to me.
