Justchex.net and protectacheck.com

On June 3, 2003, Jacob Aidlin of justchex.net and protectacheck.com sent this legal threat captured in a dccm logdir file.

Justchex.net and protectacheck.com are in the Rhyolite Software list of unwelcome domains. because of this spam. That file is also a dccm logdir file, but the target address of the spam has been censored. That target address is a "spam trap" that has never been valid and never given to anyone. Any and all mail sent to it is unsolicited, automatically marked as "extremely bulky" for the DCC, and rejected. The address has been censored from the public copy of that spam to protect it from disclosure to spammers might otherwise avoid sending spam to it.

Notice that the HELO value of oe-iw1.bizmailsrvcs.net in the spam is very similar to the HELO value of oe-mp1.bizmailsrvcs.net in Mr. Aidlin's legal threat of oe-mp1.bizmailsrvcs.net. The two mail messages were sent from the nearby IP addresses of 206.46.164.32 and 206.46.164.22. The Reply-To address of jay@justchex.net spam was the same as the administrative contact address in the whois record for justchex.net in October, 2002 when the spam was sent. (The current contact address differs, but the whois record was modified on May 5, 2003.) These facts suggest that contrary to Mr. Aidlin's claim, his company did send that spam.

Regardless of who sent that spam, Mr. Aidlin's legal threat requires that any communication be sent to the Rhyolite Software attorneys and that email from justchex.net and protectacheck.com remain unwelcome at rhyolite.com.

July 24, 2003

On July 24, 2003, Robert "Jay" McShirley sent this expression of outrage.

Notice that in addition to coincidences listed above, Mr. McShirley's return address of jay@justchex.net is the same as the Reply-To address in the spam.

Perhaps Mr. McShirley is right that Verizon was blacklisted "because email addresses on their server could be spoofed." However, consider the likelihood of someone unrelated to Mr. McShirley's company sending spam in his name advertising his company through mail systems used by his company.

I wonder if Mr. McShirley knows that no one at Rhyolite Software controls or even knowingly influences how Google sorts the "hits" when you ask about justchex.

The legal threat from Mr. Aidlin requires that all communications from their organization go from their lawyers to my lawyers. I wonder what Mr. McShirley thinks I should do with his message other than add it to this web page?

At about 4:00 pm MDT, Mr. McShirley. His opening gambit was to express surprise that the previous expression of outrage is published here despite its end:

He insisted yet again that his companies have not been involved in sending unsolicited bulk email, although he didn't seem to want to address the spam sent to a "spam trap" at rhyolite.com.

His main goal seemed to be to find out "what it would take" to get these web pages removed.

Mr. McShirley said he didn't want to get lawyers involved. I said that any legal threats would require that I hang up because after a threat or promise to sue, all communications must involve officers of the court.

We could have talked in circles for some time, but a minute or two after the start of the call I finally found the relevant records including the original legal threat. They required that we stop talking.

Why?

Why do unsolicited bulk mailers think I'll respond differently to their demands than to the same stuff from others? How can they not guess that I'm liketly react much the same every time I'm contacted?

Why do they think that if they repeat themselves enough, I'll do whatever they ask?--oh, never mind.
