On April 15, 2005, Ilie Nimigean sent this objection to the presence of his domain names in the Rhyolite Software list of unwelcome domains and IP addresses. He wrote
WHY?!?! WHY AM I ON THE LIST OF UNWELCOME DOMAIN NAMES? DID YOU KNOW THAT I CAN SUE YOU FOR DEFAMING MY NAME LIKE THIS? For some reason, I and the site that I have built are WRONGLY accused of spamming. Either, prove that I have spammed anyone, or else take my name and the site that I have built (www.faroukfriedman.com <http://www.faroukfriedman.com> ) off of your site. I AM NOT AFRAID OF TAKE SERIOUS ACTION AGAINST YOU. Ilie Nimigean Jr. Multimedia Designer
Those entries exist because of this unsolicited, unwanted bulk advertising mail or spam. (That is a dccm logdir file.) Judging from the Google NANAS record forfaroukfriedman, that was a substantial spew of spam.
In his objection, Mr. Nimigean insists on his innocence. It might be true that the advertising was paid for by a third party The claim that unknown third parties are responsible for spam is standard but irrelevant. Regardless of other considerations, all email from Mr. Nimigean is now unwelcome at rhyolite.com, because of his legal threat All communications between Mr. Nimigean and anyone at Rhyolite Software, LLC, must be handle by our lawyers. For that reason, his domain names must remain in the Rhyolite Software, LLC, list of unwelcome domains.
Three telephone calls were made on April 20, 2005 to 303-786-8846 by someone who refused to identify himself except as a concerned citizen. They started by demanding to know details about Rhyolite Software, LLC. that I consider such questions harassment when asked by someone trying to be anonymous. No one with a legitimate interest in the gross revenues, number of employees, and so forth of Rhyolite Software, LLC is anonymous. I terminate such calls as politely as possible without prolonging them by saying "goodbye" and hanging up. The third call consisted of the question "Vernon, do you have a good lawyer?"
I only suspect and do not know that this anonymous caller was concerned about the same domain names as Mr. Nimigean.
On April 21, a telephone call was received from the same or another "concerned citizen." This caller sounded somewhat different from the caller on April 20. Where the caller on April 20 sounded very tired or a little drunk, the caller on April 21 seemed alert and awake. This caller also wanted to know things that concern no one but the principals and customers of Rhyolite Software, LLC. He was most concerned about domain names (that he refused to specify) that Google associates by looking at the Rhyolite Software list of unwelcome domains but that have no "professional" connection. This caller refused to say whether he is the person who telephoned the previous day.
Later on April 21, Jane Laska sent a complaint about the group of domains that apparently includes Mr. Nimigean's name. This complaint talks about "a futureventsPR (fePR) communication" which I assume is either Mr. Nimigean's complaint or the original unsolicited bulk email or spam from news@futureventspr.com.
This complaint says something about press releases not being spam. It may also be advancing the idea that unsolicited bulk mail that does not contain "pricing, purchase options, payment methods or sale offer" is not spam. That is a standard but mistaken claim.
It might be interesting to review the Google archive of public reports of spam containing "futureventspr."
Because of the legal threats in Ms. Laska's message, all mail from her is unwelcome at rhyolite.com. Any additional communications must be via our lawyers.
